Who these terms apply to:
These Terms and Conditions govern the use of this website and the purchase of services offered by Mindful Creator, a sole trader registered in the Netherlands, owned and operated by Yenti Tan.By booking a service or using this website, you agree to these terms. If you have any questions, please contact us at [email protected] before proceeding.

Our services:
Mindful Creator offers the following services:1. Brilliant AND Booked — a 1:1 positioning, branding, and marketing strategy program.
2. Mindful Creators Club — a membership community with live sessions and coaching.
3. Breakthrough Hour — a single 60-minute 1:1 coaching session with a personalised action plan.
The scope, deliverables, and duration of each service are described on the relevant offer page. Any changes to the agreed scope of work must be confirmed in writing by both parties.

Booking and payment:
Bookings are confirmed upon receipt of payment or a signed agreement, depending on the service.- Breakthrough Hour: Full payment of €249 is required at the time of booking via Stripe. Your session will be confirmed once payment is received.
- Brilliant AND Booked: A discovery call is required before purchase. Payment terms will be agreed during that call.
- Mindful Creators Club: Membership is charged monthly. Details are provided at the time of signup.
All prices are listed in Euros and are exclusive of VAT where applicable.

Cancellation and refund policy:
- Breakthrough Hour: You may reschedule your session up to 24 hours before the scheduled time at no charge. Cancellations made less than 24 hours before the session are non-refundable. If Yenti Tan needs to cancel, a full refund will be issued or an alternative time offered.
- Brilliant AND Booked: Cancellation terms are agreed individually and outlined in your service agreement. Generally, work completed up to the point of cancellation is non-refundable.
- Mindful Creators Club: You may cancel your membership at any time, month three onwards. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.

What we expect from you:
To get the most from working together and to ensure we can deliver as promised, we ask that you:
- Show up to scheduled sessions on time and prepared.
- Complete any agreed exercises or tasks between sessions.
- Communicate openly and honestly about your goals and challenges.
- Treat all sessions, materials, and communications with respect and confidentiality.

Intellectual property:
All content, frameworks, methodologies, materials, and resources created and shared by Mindful Creator, including but not limited to the Authentic Edge Positioning™ framework, are the intellectual property of Yenti Tan.You are welcome to use what you learn in your own business. You may not reproduce, distribute, teach, or sell our materials or frameworks without prior written permission.

Confidentiality:
We treat everything you share in our sessions as confidential. We will not share your personal or business information with third parties without your consent, except where required by law.We ask that you treat any information shared by Mindful Creator, including frameworks, strategies, and proprietary materials, with the same confidentiality.

Results and disclaimer:
Coaching and strategy work requires your active participation and implementation. While we are committed to delivering our best work, we cannot guarantee specific results or outcomes.Any testimonials or case studies shared on this website reflect individual experiences and are not a guarantee of similar results for every client.

Limitation of liability:
To the fullest extent permitted by law, Mindful Creator and Yenti Tan shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website.Our total liability to you shall not exceed the amount paid for the specific service in question.

Governing law:
These Terms and Conditions are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the Dutch courts.

Changes to these terms:
We may update these Terms and Conditions from time to time. Any changes will be reflected on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.

We do not use contact forms, email signup forms, or tracking tools on this website.Personal data may be collected in the following ways:- Booking a discovery call: When you book a call via Calendly, Calendly collects your name, email address, and any information you provide in the booking form. This data is processed by Calendly on our behalf.
- Booking and paying for the Breakthrough Hour: When you book and pay for a session, your name, email address, and payment details are collected and processed by Stripe, our payment processor. We do not store your payment card information.
- Email communication: If you contact us directly by email, we will retain that correspondence to respond to your enquiry.

Why we collect your data:
We collect and process your personal data for the following purposes:- To schedule and confirm coaching sessions and calls
- To process payments for services
- To communicate with you about your booking or enquiry
- To deliver the services you have purchased
The legal basis for processing your data is the performance of a contract, or steps taken at your request prior to entering into a contract, in accordance with Article 6(1)(b) of the GDPR.

Third party processors:
